1. Acceptance of Terms

These Terms and Conditions ("Terms") constitute a legally binding agreement between you ("Client," "you," or "your") and Rebuild Home Hub ("Company," "we," "us," or "our"), a home renovation services company headquartered at 4557 De Silva St, Fremont, California 94538, USA.

By accessing our website, requesting services, signing contracts, or otherwise engaging with Rebuild Home Hub, you acknowledge that you have read, understood, and agree to be bound by these Terms, along with our Privacy Policy.

If you do not agree to these Terms, you must not use our website or engage our services. These Terms apply to all visitors, users, clients, and others who access or use our services.

⚠️ Important: These Terms govern all aspects of your relationship with Rebuild Home Hub, including pre-consultation interactions, active projects, and post-completion warranties.

2. Services Description

Rebuild Home Hub provides professional home renovation and improvement services, including but not limited to:

  • Interior design and home décor services
  • Exterior renovation and garden/landscaping services
  • Home security system installation and maintenance
  • Fire safety system installation and maintenance
  • Roof installation, repair, and maintenance
  • Solar panel installation and maintenance
  • Window installation and replacement
  • Flooring installation and maintenance
  • Bathroom renovation and remodeling
  • Home renovation financing assistance
  • Home warranty program services

Specific scope of work, materials, timelines, and deliverables for each project will be detailed in a separate written proposal or contract provided to you before work commences. These Terms supplement (but do not replace) individual project contracts.

3. Eligibility

To engage our services, you must:

  • Be at least 18 years of age
  • Be a legal owner or authorized representative of the property to be renovated
  • Have the legal capacity to enter into binding agreements
  • Not be prohibited from using our services under any applicable law
  • Provide accurate, current, and complete information during booking and throughout the project

By using our services, you represent and warrant that you meet these eligibility requirements. We reserve the right to refuse service to anyone for any lawful reason.

4. Booking & Consultations

A. Free Consultations

We offer complimentary initial consultations to discuss your project. Consultations may be conducted in-person, by phone, or via video call at our discretion. Consultations are non-binding and do not create any obligation on either party.

B. Project Proposals

Following consultation, we will provide a detailed written proposal including:

  • Scope of work and specifications
  • Materials to be used (with options and pricing tiers)
  • Estimated project timeline with milestones
  • Total cost breakdown (materials, labor, permits, overhead)
  • Payment schedule and terms
  • Warranty coverage details

C. Acceptance & Deposit

Upon acceptance of a proposal, a deposit (typically 20-30% of total project cost) is required to secure your booking and initiate material procurement. Projects are scheduled on a first-come, first-served basis subject to availability.

D. Change Orders

Any changes to the approved scope of work after project commencement require a written change order signed by both parties. Change orders may affect project cost and timeline. Additional costs will be billed separately.

5. Pricing & Payment Terms

A. Pricing

All prices are quoted in US Dollars and are valid for 30 days from the date of proposal unless otherwise stated. Prices are subject to change due to material cost fluctuations until a signed contract is in place.

B. Payment Schedule

Standard payment schedule (unless otherwise agreed):

  • Deposit: 20-30% upon contract signing
  • Progress Payment: 40% at project midpoint or upon milestone completion
  • Final Payment: Remaining balance due upon project completion and client walkthrough approval

C. Payment Methods

We accept the following payment methods:

  • Credit/Debit Cards (Visa, MasterCard, American Express, Discover)
  • Bank transfers (ACH/Wire)
  • Personal/business checks (subject to clearance)
  • Approved financing through our lending partners
  • Cash (in-person only)

D. Late Payments

Payments overdue by more than 15 days are subject to a late fee of 1.5% per month (18% annually) or the maximum rate permitted by law, whichever is less. We reserve the right to pause or terminate work on projects with overdue payments.

E. Financing

For clients using our financing partners, separate terms and conditions apply from the lending institution. Rebuild Home Hub is not a party to the financing agreement but facilitates the application process.

6. Cancellation & Refund Policy

A. Client Cancellation

  • Before work begins: Full refund of deposit minus a cancellation fee of 10% or $500 (whichever is greater) within 48 hours of signing. After 48 hours, deposit becomes non-refundable.
  • During project: If client cancels after work has commenced, client is responsible for all costs incurred (materials purchased, labor performed, permits obtained) plus 15% cancellation fee on remaining project value.
  • After completion: No refunds available after final walkthrough and client acceptance.

B. Company Cancellation

Rebuild Home Hub reserves the right to cancel or postpone projects due to force majeure events, material unavailability, or safety concerns. In such cases, a full refund of all payments will be issued within 14 business days.

C. Rescheduling

Clients may request rescheduling up to 72 hours before the scheduled start date at no additional cost. Requests within 72 hours may incur a rescheduling fee of $250.

7. Warranties & Guarantees

A. Workmanship Warranty

All renovation work performed by Rebuild Home Hub carries a workmanship warranty:

  • Essential Package: 1-year workmanship warranty
  • Premium Package: 5-year workmanship warranty
  • Luxury Package: Lifetime workmanship warranty (transferable to new owners)

B. Material Warranties

Materials carry manufacturer warranties which will be transferred to you upon project completion. We assist with warranty claims for the duration of our workmanship warranty period.

C. Warranty Exclusions

Warranties do not cover:

  • Normal wear and tear
  • Damage from improper use or maintenance
  • Damage from natural disasters, accidents, or acts of God
  • Modifications or repairs performed by unauthorized parties
  • Pre-existing conditions not addressed in the project scope

D. Satisfaction Guarantee

If you are not satisfied with any aspect of the completed work, notify us within 14 days of project completion. We will rectify the issue at no additional cost. This guarantee covers defects in workmanship, not subjective design preferences approved during the planning phase.

8. Client Responsibilities

To ensure smooth project execution, clients agree to:

  • Provide clear and timely access to the property during agreed work hours
  • Secure necessary HOA approvals or neighbor notifications where required
  • Remove personal belongings, valuables, and fragile items from work areas
  • Maintain adequate homeowner's insurance throughout the project
  • Make timely decisions and approvals to avoid project delays
  • Provide accurate property information (utilities, structural issues, asbestos, lead paint, etc.)
  • Keep children and pets away from active construction zones
  • Maintain a safe and accessible work environment
  • Notify us immediately of any concerns, damages, or safety issues

Failure to fulfill these responsibilities may result in project delays, additional costs, or voided warranties.

9. Limitation of Liability

A. General Limitation

To the maximum extent permitted by applicable law, Rebuild Home Hub shall not be liable for:

  • Indirect, incidental, special, consequential, or punitive damages
  • Loss of profits, revenue, data, or business opportunities
  • Cost of substitute services or temporary housing during renovations
  • Damages exceeding the total amount paid by client for the specific service at issue

B. Force Majeure

Neither party shall be liable for delays or failures in performance resulting from causes beyond reasonable control, including but not limited to: natural disasters, pandemics, war, terrorism, labor disputes, government actions, material shortages, supply chain disruptions, or utility outages.

C. Assumption of Risk

Client acknowledges that home renovation inherently involves some disruption, noise, dust, and temporary inconvenience. Client assumes reasonable risks associated with construction activities and agrees to cooperate in minimizing impact.

10. Indemnification

You agree to indemnify, defend, and hold harmless Rebuild Home Hub, its officers, directors, employees, contractors, agents, and affiliates from and against any claims, liabilities, damages, losses, costs, and expenses (including reasonable attorneys' fees) arising from:

  • Your breach of these Terms or any project contract
  • Your violation of any applicable law or regulation
  • Your negligent or willful misconduct
  • Your failure to fulfill client responsibilities outlined in Section 8
  • Any injury or damage caused by you, your family members, guests, or pets during the project
  • Unauthorized modifications to our work after project completion

11. Intellectual Property

A. Our Content

All content on our website (text, graphics, logos, images, videos, software, designs) is the property of Rebuild Home Hub or its licensors and is protected by copyright, trademark, and other intellectual property laws. You may not reproduce, distribute, modify, or create derivative works without our written permission.

B. Design Materials

Custom designs, plans, drawings, and 3D renderings created by Rebuild Home Hub remain our intellectual property until full payment is received. Upon full payment, you receive a license to use these materials solely for the specific property and project for which they were created.

C. Client Content

You retain ownership of any content you provide (photos, documents, preferences). By providing content, you grant us a limited license to use it solely for the purpose of delivering our services to you.

D. Portfolio Rights

Unless otherwise agreed in writing, Rebuild Home Hub retains the right to photograph completed projects for portfolio, marketing, and promotional purposes. Client privacy is respected — we will not photograph personal items or include identifying information without consent.

12. Dispute Resolution

A. Informal Resolution

In the event of any dispute, both parties agree to first attempt to resolve the issue through good-faith negotiation for a period of 30 days from written notice of the dispute.

B. Mediation

If informal resolution fails, parties agree to participate in non-binding mediation with a mutually agreed-upon mediator before pursuing formal legal action. Mediation costs will be shared equally.

C. Binding Arbitration

Any unresolved disputes shall be settled by binding arbitration administered by the American Arbitration Association (AAA) under its Commercial Arbitration Rules. Arbitration will take place in Alameda County, California. The arbitrator's decision is final and binding.

D. Class Action Waiver

Both parties agree that any disputes will be resolved on an individual basis and not through class action, consolidated action, or representative proceeding.

E. Governing Law

These Terms are governed by and construed in accordance with the laws of the State of California, without regard to conflict of law principles.

13. Termination

A. Termination by Client

Clients may terminate the agreement at any time subject to the cancellation and refund terms in Section 6. Termination must be in writing.

B. Termination by Company

Rebuild Home Hub may terminate the agreement immediately if:

  • Client fails to make payments when due
  • Client breaches any material term of these Terms or the project contract
  • Client engages in abusive, threatening, or illegal behavior toward our team
  • Client fails to provide access or fulfill responsibilities under Section 8
  • Continuing the project would violate applicable laws or safety regulations

C. Effects of Termination

Upon termination, client is responsible for payment of all work completed and materials purchased up to the termination date. Any remaining balance will be refunded within 30 days after deduction of amounts owed.

14. Modifications to Terms

Rebuild Home Hub reserves the right to modify these Terms at any time. Changes will be effective immediately upon posting on our website with an updated "Last Updated" date. For active projects, material changes will not apply retroactively without your written consent.

Your continued use of our services after changes are posted constitutes acceptance of the modified Terms. We encourage you to review these Terms periodically. Major changes will be communicated via email or prominent website notice.

Severability

If any provision of these Terms is found to be invalid, illegal, or unenforceable, the remaining provisions shall continue in full force and effect. The invalid provision shall be modified to the minimum extent necessary to make it valid and enforceable.

Entire Agreement

These Terms, together with any signed project contract and our Privacy Policy, constitute the entire agreement between you and Rebuild Home Hub and supersede all prior agreements, representations, and understandings.
